1. Agreement to Terms

By accessing or using Pet-Trax ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including pet owners, pet finders, and anyone who scans a Pet-Trax QR code.

2. Description of Service

Pet-Trax provides a pet identification and recovery service that includes:

• Pet Profiles: Digital profiles for your pets with photos, medical information, and contact details
• QR Code Tags: Physical tags with unique QR codes that link to your pet's profile
• Lost Pet Alerts: Notification system to alert nearby users when a pet is reported lost
• Finder Communication: Secure messaging between pet finders and owners

3. Account Registration

Eligibility

You must be at least 18 years old or have parental/guardian consent to use this Service. By using Pet-Trax, you represent that you meet this requirement.

Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete information when creating your account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree NOT to use Pet-Trax to:

• Upload false, misleading, or fraudulent pet information
• Impersonate another person or misrepresent your identity
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for commercial purposes without authorization
• Upload inappropriate, offensive, or illegal content

5. Pet Information and Content

Ownership

You retain ownership of all content you upload to Pet-Trax, including photos and pet information. By uploading content, you grant Pet-Trax a non-exclusive, worldwide license to use, display, and distribute this content solely for the purpose of providing the Service.

Accuracy

You are responsible for ensuring that all pet information you provide is accurate and up-to-date. Inaccurate information may impede the recovery of a lost pet.

Appropriate Content

All uploaded photos must be of pets. We reserve the right to remove any images that are inappropriate, offensive, or not related to pet identification.

6. QR Tags and Products

Orders and Shipping

• QR tags are custom-made for each pet and are non-refundable once shipped
• Shipping times are estimates and may vary based on location and carrier
• Risk of loss passes to you upon delivery to the carrier

Tag Functionality

• QR tags link to your pet's digital profile on our platform
• Tag functionality depends on maintaining an active Pet-Trax account
• If your account is deleted, associated tags will no longer display pet information

7. Subscription and Payment

Free and Premium Plans

Pet-Trax offers both free and paid subscription options. Premium features are available only to paying subscribers as described on our pricing page.

Billing

• Premium subscriptions are billed monthly or annually as selected
• Subscription fees are charged in advance and are non-refundable
• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period

Price Changes

We reserve the right to modify subscription pricing. Existing subscribers will be notified at least 30 days before any price increase takes effect.

8. Lost Pet Alerts

The Lost Pet Alert feature is provided as a courtesy service to help reunite lost pets with their owners. Pet-Trax does not guarantee:

• That alerts will reach all users in your area
• That your pet will be found or returned
• The accuracy of location data shared by finders

Lost Pet Alerts are moderated for quality and may be delayed or rejected if they contain inappropriate content or appear fraudulent.

9. Finder Responsibilities

If you find a pet with a Pet-Trax tag:

• Please treat the animal with care and kindness
• Use the provided communication methods to contact the owner
• Do not misuse the owner's contact information
• Consider the pet's safety when choosing to share your location

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Pet-Trax is provided "as is" without warranties of any kind
• We do not guarantee that the Service will be uninterrupted or error-free
• We are not responsible for any actions taken by pet finders or third parties
• Our liability is limited to the amount you paid for the Service in the past 12 months
• We are not liable for any indirect, incidental, special, or consequential damages

11. Indemnification

You agree to indemnify and hold harmless Pet-Trax, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you upload to the Service

12. Intellectual Property

The Pet-Trax name, logo, website design, and all related intellectual property are owned by Pet-Trax. You may not use our trademarks without prior written permission.

13. Privacy

Your use of Pet-Trax is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

14. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Harassment of other users or staff
• At your request

Upon termination, your right to use the Service will cease immediately. You may request deletion of your data as described in our Privacy Policy.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last Updated" date.

Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or the Service will be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.
